City of Morgantown and Chad Johnson Defendants In Missing Candy Case

The City of Morgantown and Chad Johnson are defendants in a civil action suit by Marten Transport, LTD, over missing candy from an accident on the Natcher Parkway over a year ago. 

According to the verified complaint on May 12, 2011, a Marten employee was operating a truck/trailer in Butler County.  The vehicle overturned and Marten Transport, LTD, contracted Chad Johnson d/b/a Chad’s Body Shop and Wrecker Service and the City of Morgantown to take possession, custody and control of the cargo contained within the vehicle and secure, maintain and store on behalf of Marten Transport, LTD, until such time as they could arrange to pick up the cargo. 

The cargo (candy) was transported to the Eva J. Hawes Agricultural Exposition and Community Building where it was stored for six days at the cost of $1,000 per day. Marten Transport has paid the City of Morgantown and Chad Johnson for their services.   The suit alleges that upon return of possession and control of the cargo a portion of the cargo was missing.

The suits alleges eight counts, including Negligence/Gross Negligence; Breach of Contract; Conversion; Constructive Trust; Breach of Bailment; Unjust Enrichment; Negligent Misrepresentation/Violation of Uniform Commercial Code; and Breach of Implied Covenant of Good Faith and Fair Dealing.

According to Johnson the driver of the truck said that if the box was busted open, it was no good and it was tossed to the side, and several people on the scene were loading candy into their vehicles.  Johnson stated that Marten Transport, LTD is claiming to be missing around 230 cases of candy.

Marten Transport, LTD is incorported in Delware and its principal office is located at 129 Marten Street, Mondovi, Wisconsin.
