Butler County Jailer named in second, unrelated lawsuit

Shane Williams, of Centertown, Kentucky has filed a lawsuit Terry M. Fugate, Butler County Jailer, in his personal and official capacities. In a civil action filed on April 1, 2013 in the United States District Court, Bowling Green Division, Williams claims he sustained physical and sexual assault at the hands of fellow inmates from approximately the time of his incarceration until his release.  He also claims he was denied medical treatment for his injuries.

The document states, “the acts and/or omissions were motivated in whole or in part by a culture of indifference at the Butler County Jail under Terry Fugate’s control and management that included the following:

a.)    Unreasonably and improperly placing new inmates with little or no history of incarceration, such as Shane Williams, with other inmates whose dangerous and vicious tendencies are reasonably foreseeable based on their past conduct: and

b.)    Improper and inadequate jail staffing and training such that unreasonable and unnecessary delays in the detection and prevention of assaults on inmates, such as Shane Williams, inevitably occur.

c.)     Improper and inadequate jail medical treatment for Shane Williams’ injuries sustained before his release.

The complaint also states that Fugate’s actions and/or omissions were motivated in whole or in part, in bad faith, with a reckless disregard to inmate safety, and with corrupt motive to gain political and personal benefit by reduced costs at the Butler County Jail associated with medical care.

Williams demands a trial by jury, judgment against the defendant in an amount in excess of the minimum jurisdiction of the Court and an amount determined to be fair and reasonable by a fair and competent jury; for pre-judgment and post-judgment interest on said judgment at the highest allowable legal rate until paid; for statutory attorney’s fee and costs; foe leave to amend and for any other just relief.
